Springbank landowners withdraw legal application

In May 2018, a Notice of Application was filed by six landowners seeking to quash the Canadian Environmental Assessment Agency (CEAA)’s decision that the revised Environmental Impact Statement (EIS) conformed to the required guidelines set forth earlier by the CEAA.

 

We’ve learned that this application has been withdrawn. The federal court hearing that was scheduled for November has been canceled and this matter will not proceed any further.

This is very welcome news since, had the landowners been successful in their application, it would likely have meant further delays for the Springbank Project.

 

In case you missed it: The EIS is progressing through regulatory reviews by the CEAA and National Resources Conservation Board (NRCB). Currently, the federal regulatory clock is paused at day 110 of 365 as Alberta Transportation responds to additional information requests from the CEAA. It is anticipated that a response to all questions should be submitted by mid-December, which will then restart the clock.
